ALBUQUERQUE, N.M. (KRQE) – One of three teens accused of intentionally crashing a stolen car into a 63-year-old Albuquerque man in 2024 pleaded guilty to second-degree murder Thursday.

APD arrested 13-year-old Johnathan Overbay, 15-year-old William Garcia, and 11-year-old Messiah Hayes for the death of Scott Habermehl, who was hit while riding his bicycle to work at Sandia National Laboratories on May 29, 2024.

Overbay, who entered the plea Thursday, was 12 years old at the time of the crime and was behind the wheel of the car when they hit Habermehl in the bike lane on Moon Street and Aspen Avenue, according to the District Attorney’s Office.

APD said video of the crime that was posted to social media helped solve the case. The video was taken by the backseat passenger, who police believe was Garcia.

“Just bump him. Bump him? Yeah, just bump him. Go like 15, 20,” the teens were heard saying in the video. Meanwhile Hayes, who police believe was in the passenger seat, was seen waving a gun and laughing.

Overbay will remain incarcerated until he is 21 years old. The cases involving the Garcia and Hayes are still pending, according to the DA’s office.
