Judge hears arguments for a new trial or dismissal for armorer in fatal shooting on set of “Rust”

SANTA FE, N.M. (KRQE) – In a hearing Thursday, Hannah Gutierrez looked to get a new trial or have her case dismissed. Gutierrez is serving an 18-month sentence for involuntary manslaughter in the fatal shooting of cinematographer Halyna Hutchins on the movie set of “Rust” in 2021.

Gutierrez’s attorney previously filed a motion asking for a new trial in her case or to have it dismissed altogether. They are also asking that Gutierrez be released during the process. The motion came after actor Alec Baldwin, who was also involved in the shooting, went on trial in July 2024 and had his case dismissed.

Judge Mary Marlowe Sommer heard arguments Thursday morning, but she will make a decision on the motion at a later date.
