Judge rules convicted murder will be sentenced as an adult

ALBUQUERQUE, N.M. (KRQE) – A Judge ruled a man convicted of a murder at 16-years-old did not do well in a young adult treatment program and will now be sentenced as an adult.

In August of 2020 Cesar Lozano-Chavez ran over and killed Davon Frydrych at Los Alto Skate Park in Albuquerque. Witnesses Frydrych tried to break up a fight between Lozano-Chavez and two other people at the skatepark. That’s when witnesses say Lozano-Chavez got into his vehicle to leave the skate park, but then turned around and drove toward Frydrych, hitting and killing him.

In December 2023, Lozano-Chavez was found guilty of second-degree murder and sentenced to young adult court. During an amenability hearing Monday morning, Judge Cindy Leos says that treatment did not go as planned. Judge Leos ruled that Lopez-Chavez was not amenable for treatment and will hand down an adult-sentence in late July.
