Appeals court will not rule on Hannah Gutierrez’s appeal until 1st Judicial Court ruling

SANTA FE, N.M. (KRQE) – The Court of Appeals said the First Judicial Court has to decide if Hannah Gutierrez will get a new trial before they decide to take up her appeal. Gutierrez’s lawyers filed a motion asked the appeals court to force the Santa Fe court to rule on their motion for a new trial.

She is currently serving an 18-month sentence for her role in the deadly shooting on the Rust movie set in 2021. Alec Baldwin had his involuntary manslaughter charge dismissed after a judge ruled prosecutors hid evidence from the defense. Gutierrez’s lawyers claim that is enough to have her conviction overturned or at least get her a new trial.

If the First Judicial Court denies the motion for a new trial, the case will move to the appeals court.
