ALBUQUERQUE, N.M. (KRQE) – A former Albuquerque Public Schools (APS) bus attendant will not be held behind bars through trial for child abuse charges involving a special needs student.

Debbie Chavira is accused of abusing the student on the bus. Police said video shows Chavira, slapping the student with a plastic sign. According to a criminal complaint, these incidents date back to late August where Chavira is accused of hitting the student on the arm, neck, torso, face, and other areas several times.
The state asked for Chavira to remain behind bars based on the violent nature of the crime. Chavira’s lawyers argued she is no longer employed by APS so there is no risk to other children. Judge Joseph Montano ruled Chavira will not stay behind bars through trial, placing her under the supervision of pretrial services.
