Man serving time for murder sentenced for another killing

ALBUQUERQUE, N.M. (KRQE) – Xavier Marquez, already serving a 17 year sentence for killing a man and wounding his service dog, was sentenced Tuesday for killing another man.

Marquez pleaded no contest to voluntary manslaughter and tampering with evidence charges in connection to the shooting death of Daniel Bustos outside the Travel Lodge at Coors and Ilif in June 2021. Marquez claimed self defense in the shooting. Bustos was found with a gun on him, but all bullet casings found at the scene matched Marquez’s gun.

Judge Joseph Montano sentenced Marquez to five years, the maximum allowed under the plea deal. The sentence will run consecutive to his 17 year sentence.
