State Supreme Court to rule on Hobbs woman’s release during appeal process

HOBBS, N.M. (KRQE) – The New Mexico Supreme Court has a date scheduled to decide whether Alexis Avila will be released from prison during her appeal. Last year, a jury convicted Avila for tossing her newborn into a garbage bin two years ago. She received a 16-year sentence. A district court judge ruled she would remain behind bars during the appeal process but the appeals court eventually ruled Avila should be released.


New Mexico man facing federal charges for February shooting

Now, the New Mexico Supreme Court has stepped in to decide what should happen as she goes through the appeal. The New Mexico Department of Justice hopes it rules to put Avila back in prison. Avila’s hearing in the state Supreme Court is scheduled for November 7.
