The Bucharest Court of Appeal ordered the postponement of the extradition of brothers Andrew and Tristan Tate to Great Britain until the resolution of the case in which they were sent to court in Romania, the judges determining that they should be released.
Brothers Andrew and Tristan Tate had been detained on Monday evening, based on European arrest warrants issued in Great Britain, for sexual offenses in Great Britain.
According to the court’s decision, the Romanian magistrates agreed to the extradition request, but postponed the procedure, until the moment when the case of the Tate brothers in Romania will be settled definitively.
“On the basis of art. 109 par. 1 related to art. 104 par. 7 and art. 110 par. 2 sentence 1 of Law no. 302/2004, admits the notification formulated by the Prosecutor’s Office attached to the Bucharest Court of Appeal. Orders the execution of the arrest warrant issued on 19 January 2024 by a senior territorial judge (chief magistrate) of the Westminster Magistrates’ Court (of the United Kingdom of Great Britain and Northern Ireland), based on the arrest warrant dated January 19, 2023, issued by the Magistrate’s Court in Westminster, in the name of the requested person, Tate Emory Andrew. It orders the postponement of the surrender of the requested person until the final resolution of the case that forms the object of the criminal file with the number 18906/3/2023 pending at the Bucharest Court, and in in the event that, in that case, a sentence of imprisonment will be pronounced against the requested person, with execution in detention, until release as a result of conditional release or until the execution of the term sentence”, established the CAB with reference to Andrew Tate, solution which is identical in the case of Tristan Tate.
According to the court’s decision, the judges issued a preventive arrest warrant on their behalf, but it will be applied only after the settlement of the case in Romania. The court also determined that the Tate brothers should be released immediately.
“Finds that the requested person understands to avail himself of the benefit of the rule of specialty. It orders the arrest of the requested person with a view to surrender to the British judicial authorities for a period of 30 days, starting from the date of termination of the reasons that justified the postponement of the surrender. The court’s decision can be appealed. During the trial at the Bucharest Court of Appeal, the Tate brothers stated that they do not want to be extradited from Romania, because this is their home and they want to restore their reputation.
