Warrants show that between 10 a.m. and 2 p.m. on March 13, Smith allegedly entered a residence on Wildwood Loop in Marion County with a Taurus handgun and kidnapped Machado-Fore. Smith is accused of taking her vehicle, a 2001 BMW, and driving it to Jones Drive in Dillon County where he allegedly shot her in the back of the head.

Smith and an unnamed co-defendant then went back to the Wildwood Loop home between 10 p.m. and 11:50 p.m. that night “to commit burglary and grand larceny,” according to the warrants. News13 asked the Marion County Sheriff’s Office about the co-defendant and was told they are not releasing that information at this time.

During the kidnapping, the warrants accuse Smith of being armed with a Taurus handgun, a Ruger .243 rifle, a Marlin .22 rifle, a New England .410 rifle, a Marlin 30/30 rifle, a Mossberg .20 gauge shotgun and a Maverick .12 gauge shotgun.

Her death was ruled a homicide by Dillon County Coroner Donnie Grimsley four days later.

He is also charged in the March 15 killing of New Mexico State Police Officer Justin Hare. Smith is accused of ambushing Hare when he responded to a report of a disabled vehicle — Machado-Fore’s BMW.

Authorities said earlier this month that Smith, who has a lengthy criminal history in South Carolina and will remain in federal custody. The newly released warrants show Smith has previous convictions for grand larceny and taking hostages by an inmate.
